Fargo police used facial recognition technology to identify a suspect in a fraud case. The system matched the suspect to a Tennessee woman who insists she’s never been to North Dakota. She was arrested, jailed, and forced to prove her innocence. The Fargo police chief has since apologized for what they’re calling “mistakes” in the AI-aided arrest.
Let’s be clear about what “mistakes” means here: a grandmother was thrown in jail because an algorithm made a guess and humans treated that guess as gospel truth.
Why This Keeps Happening
I’ve tested dozens of AI tools that claim near-perfect accuracy. The marketing materials are always impressive. The reality? These systems fail more often than vendors admit, and they fail in ways that disproportionately harm specific groups of people.
Facial recognition technology has documented accuracy problems, especially with women and people of color. Study after study confirms this. Yet police departments keep deploying these systems as if they’re foolproof lie detectors.

They won’t show you the failure rates in real-world scenarios with poor lighting, odd angles, or subjects who don’t match their training data demographics.
They’ll talk about their technology being “state-of-the-art” without mentioning that state-of-the-art still means wrong often enough to ruin lives. They’ll emphasize the cases where the system works without dwelling on the cases where it catastrophically fails.

This Tennessee woman isn’t the first person wrongly arrested because of facial recognition, and she won’t be the last. Similar cases have emerged in Michigan, New Jersey, and other states. Each time, officials express surprise and promise to review their procedures. Then another department makes the same mistake.
The pattern is clear: deploy the technology first, deal with the consequences later, apologize when someone’s life gets destroyed, repeat.
What Needs to Change
Police departments need to treat AI facial recognition for what it is: a lead generation tool, not evidence. A match should trigger further investigation, not an arrest. Officers need training on the limitations and failure modes of these systems. And there need to be consequences when departments treat algorithmic suggestions as definitive proof.
Vendors need to be honest about accuracy rates in real-world conditions, not just lab settings. They need to disclose demographic performance disparities. And they need to stop marketing these tools as if they’re infallible.
Most importantly, we need legal frameworks that recognize AI-generated evidence for what it is: probabilistic, error-prone, and insufficient on its own to deprive someone of their freedom.
The Real Cost
A Tennessee grandmother spent time in jail for crimes she didn’t commit in a state she’s never visited. That’s not a technical glitch or an unfortunate edge case. That’s a fundamental failure of how we’re deploying AI in high-stakes situations.
Every AI tool I review gets judged on whether it does what it claims. Facial recognition systems claim to identify people accurately. When they fail, the cost isn’t a bad user experience or wasted money. It’s someone’s freedom, reputation, and sense of security.
The Fargo police chief apologized. That doesn’t give this woman back the time she spent in jail or erase the trauma of being arrested for crimes she didn’t commit. Apologies don’t fix broken systems. Better standards, accountability, and honest assessment of AI limitations might.
